Albanian opposition leader’s daughter, called to testify over allegations against judge

Argita Malltezi, daughter of Democratic Party leader Sali Berisha, appeared before the Special Anti-Corruption Prosecution Office (SPAK) on Thursday to provide testimony following her public allegations against judge Irena Gjoka. Malltezi had accused Gjoka of soliciting a €500,000 bribe from a former Socialist Party official, a claim she says was based on media reports. However, following the call to testify, she seemed to back pedal on her accusations against the judge.

Why is this important: The investigation into Malltezi’s accusations comes amid heightened debate over Albania’s justice system and its capacity to address politically sensitive claims. Judge Gjoka had previously ordered house arrest measures for Malltezi’s father, Sali Berisha, and her husband, Jamarbër Malltezi, as part of the high-profile “Partizani” corruption case. It is crucial for SPAK to thoroughly investigate these allegations and uncover the truth, especially given the history of politically motivated attacks and “character assassinations” used by powerful figures to pressure and intimidate the justice system over the years.

Context: SPAK launched the investigation in response to a formal complaint by judge Gjoka in October 2024, who denied the allegations and called for legal action. Gjoka has been the subject of criticism from the Berisha family following her decisions in the “Partizani” case, which include measures against Berisha and Jamarbër Malltezi.

Malltezi’s testimony has raised questions about the influence of political rhetoric on Albania’s justice system. SPAK is under pressure to handle the case transparently and fairly to maintain public trust in its ongoing reform efforts.

What did Malltezi say: After her appearance at SPAK, Malltezi clarified her statements, emphasizing that she only had raised questions based on media reports rather than direct evidence.

“I referred to media reports from August 2024. I do not possess any evidence, nor have I made direct accusations. I asked SPAK to clarify whether such a video exists,” Malltezi said.

Her comments mark a notable shift from her initial public statements, prompting speculation that she is stepping back from her original claims.

What’s next: Legal experts have noted that Malltezi, as the source of the allegations, now carries the burden of proof to substantiate her remarks.
